Description of Service
Shadow Messenger is a service that provides a platform enabling users to deliver messages to specified phone numbers. Users can send text messages to recipients worldwide through the Shadow Messenger app.
Definitions
Client: Any natural person of at least sixteen (16) years of age or legal entity who uses the App.
Agreement: The agreement between Shadow Messenger and the Client regarding the use of the App.
Parties: Shadow Messenger and the Client.
Product: The SMS service(s) provided by Shadow Messenger.
Applicability
These Terms and Conditions apply to all interactions with Shadow Messenger and govern the legal relationships between the Parties. The applicability of any of the Client’s general terms and conditions is explicitly excluded.
Account and Usage
Users may access Shadow Messenger with or without creating an account. Certain functionalities are limited to registered users.
Users are responsible for maintaining the confidentiality of account information and for all activities under their account.
Pricing
The pricing for sending messages is detailed on our Pricing page and varies based on the receiver’s mobile number region. All prices are inclusive of applicable taxes.
Payments
Payment for services must be completed immediately upon service confirmation. Details regarding accepted payment methods and terms are available during the checkout process.
As users visits our website and tries to send a message to the specified recipient’s number, we ask them to make a payment before sending it. A part of the payment will be used for the SMS service provider and server maintenance.
User Conduct
Users must not send messages that are illegal, harmful, or infringe on the rights of others. Shadow Messenger reserves the right to terminate access for conduct that violates these terms.
Regarding security and abuse
We use advanced AI to filter messages that can understand: hate, hate/threatening, harassment, harassment/threatening, self-harm, self-harm/intent, self-harm/instructions, sexual, sexual/minors, violence, violence/graphic. And we do not send any message that has more than a threshold value of the above-mentioned categories. In order to fulfil this purpose, we use OpenAI moderations API.
Privacy
Shadow Messenger is committed to protecting your privacy. Our Privacy Policy, available on our website, governs the collection, use, and disclosure of personal information.
Intellectual Property
All content included on the App, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the App, is the property of Shadow Messenger or its suppliers and protected by copyright and other laws.
Limitation of Liability
Shadow Messenger will not be liable for any damages of any kind arising from the use of this App, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
Modifications to the App
Shadow Messenger reserves the right to modify or discontinue, temporarily or permanently, the App (or any part thereof) with or without notice at any time.
Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Changes to Terms
Shadow Messenger reserves the right to update the Terms and Conditions at any time. When we do, we will revise the updated date at the bottom of this page. Continued use of the App after any such changes shall constitute your consent to such changes.
